2g Scam: CBI, ED to appeal against verdict

Why in News?

A Delhi court recently acquitted all accused, including former Telecom Minister in the 2G spectrum allocation cases.

 

FACTS FOR PRELIMS

Background

The 2g spectrum allocation was made in 2008 without auction or any revision in the entry fee discovered by auction in 2001, resulting in companies gaining a pecuniary advantage.

The SC, in its writ jurisdiction, tested the legality of 2G license allocations and finally in 2012 struck down the allocation on the ground that the allocation was arbitrary, as the transparent procedure of public action was not followed.

Recently a special judge acquitted all accused on the grounds of criminality since any evidence of bribe or gain made by the accused could not be proved.

 

ENFORCEMENT DIRECTORATE (ED)

  1. It is a law enforcement agency and economic intelligence agency responsible for enforcing economic laws and fighting economic crime in India.
  2. It is a part of and operates under the aegis of Department of Revenue of the Union Ministry of Finance.
  • Director of ED is appointed by Appointments Committee of the cabinet (ACC), which is chaired by the Prime Minister.
  1. The ED is mandated to enforce- a) The Prevention of Money Laundering Act, 2002 b) Foreign Exchange Management Act

 

CENTRAL BUREAU OF INVESTIGATION

i) It was set up in 1963 under a resolution of the Ministry of Home Affairs as per the recommendations of the Santhanam committee. Later, it was transferred to the Ministry of Personnel and now it enjoys the status of an attached office (Under Department of Personnel and Training)

ii) The CBI is not a statutory body it derives its powers from the Delhi Special Police Establishment Act, 1946.

iii) It is the main investigation agency of the Central government. It plays an important role in the prevention of corruption and maintaining integrity in administration. It also provides assistance to the Central Vigilance Commission.

iv)The Director of the CBI is appointed by the Central government on the recommendation of a committee comprising of –

-Central Vigilance Commission as chairperson

-Vigilance commissioners

-Secretary, Minister of Home Affairs

-Secretary (Coordination and Public Grievances) in the Cabinet Secretariat.
